Yet, the recent and increasing attempts by the EU and its Member States to evade their asylum responsibilities by outsourcing asylum processing and refugee protection risk undermining the international protection system. The undersigned human rights and humanitarian organisations are alarmed by these developments and urge the EU and its Member States to safeguard the right to territorial asylum in Europe.\u003C\u002Fspan>\u003C\u002Fp>\n\u003Cp> \u003C\u002Fp>\n\u003Cp>\u003Cspan style=\"font-weight: 400;\">Discussions on the externalisation of asylum are not new, and have been consistently criticised, contested and rejected over the years. T\u003C\u002Fspan>\u003Cspan style=\"font-weight: 400;\">he\u003C\u002Fspan>\u003Ca href=\"http:\u002F\u002Fchrome-extension\u002F\u002Fefaidnbmnnnibpcajpcglclefindmkaj\u002Fhttps:\u002F\u002Fwww.statewatch.org\u002Fmedia\u002Fdocuments\u002Fnews\u002F2018\u002Fjul\u002Feu-council-com-paper-disembarkation-options.pdf\"> \u003Cspan style=\"font-weight: 400;\">European Commission\u003C\u002Fspan>\u003C\u002Fa>\u003Cspan style=\"font-weight: 400;\"> itself ruled out the legal feasibility of such models in 2018, describing them as “neither desirable nor feasible”. \u003C\u002Fspan>\u003Cspan style=\"font-weight: 400;\">Global protection needs are higher than ever and low and middle income countries are hosting \u003C\u002Fspan>\u003Ca href=\"https:\u002F\u002Fwww.unhcr.org\u002Fabout-unhcr\u002Fwho-we-are\u002Ffigures-glance\">\u003Cspan style=\"font-weight: 400;\">75%\u003C\u002Fspan>\u003C\u002Fa>\u003Cspan style=\"font-weight: 400;\"> of the world’s refugees. Despite this, there has been a recent upsurge in proposals to shift the processing of asylum applications, or indeed the responsibility for providing refugee protection, to non-EU countries.\u003C\u002Fspan>\u003C\u002Fp>\n\u003Cp> \u003C\u002Fp>\n\u003Cp>\u003Cspan style=\"font-weight: 400;\">Italy, for instance, is currently seeking to process asylum applications of certain groups of asylum seekers outside of its territory, from detention in Albania – which risks leading to prolonged, \u003C\u002Fspan>\u003Ca href=\"https:\u002F\u002Fwww.amnesty.org\u002Fen\u002Fdocuments\u002FEUR30\u002F7587\u002F2024\u002Fen\u002F\">\u003Cspan style=\"font-weight: 400;\">automatic detention\u003C\u002Fspan>\u003C\u002Fa>\u003Cspan style=\"font-weight: 400;\">, a denial of access to fair asylum procedures with necessary procedural guarantees, and delayed disembarkation for people rescued or intercepted at sea. \u003C\u002Fspan>\u003Ca href=\"https:\u002F\u002Fwww.dr.dk\u002Fnyheder\u002Fpolitik\u002Fdanmark-samler-over-halvdelen-af-eu-landene-i-faelles-opraab-vil-have-modtagecentre\">\u003Cspan style=\"font-weight: 400;\">Others\u003C\u002Fspan>\u003C\u002Fa>\u003Cspan style=\"font-weight: 400;\">, such as \u003C\u002Fspan>\u003Ca href=\"https:\u002F\u002Fwww.clingendael.org\u002Fsites\u002Fdefault\u002Ffiles\u002F2024-02\u002FClingendael_Report_In_Search_of_Control_Denmark.pdf\">\u003Cspan style=\"font-weight: 400;\">Denmark\u003C\u002Fspan>\u003C\u002Fa>\u003Cspan style=\"font-weight: 400;\"> and \u003C\u002Fspan>\u003Ca href=\"https:\u002F\u002Fwww.amnesty.de\u002Ffluechtlinge-schutzsuchende-auslagerung-asylverfahren\">\u003Cspan style=\"font-weight: 400;\">Germany\u003C\u002Fspan>\u003C\u002Fa>\u003Cspan style=\"font-weight: 400;\">, are assessing the feasibility of this type of arrangement. \u003C\u002Fspan>\u003Ca href=\"https:\u002F\u002Fuim.dk\u002Fmedia\u002F12635\u002Fjoint-letter-to-the-european-commission-on-new-solutions-to-address-irregular-migration-to-europe.pdf\">\u003Cspan style=\"font-weight: 400;\">15 EU Member States\u003C\u002Fspan>\u003C\u002Fa>\u003Cspan style=\"font-weight: 400;\"> and some political groups have endorsed similar \u003C\u002Fspan>\u003Cspan style=\"font-weight: 400;\">shortsighted measures to shift asylum processing outside EU territory and encouraged the European Commission to explore ways to facilitate this through further legislative reform, including through a watered down ‘safe third country’ concept.\u003C\u002Fspan>\u003C\u002Fp>\n\u003Cp> \u003C\u002Fp>\n\u003Cp>\u003Cspan style=\"font-weight: 400;\">These attempts must be seen in the context of parallel containment efforts that seek to stem departures and prevent the arrival of asylum seekers to EU territory through partnership agreements with third countries, with little to no attention to the human rights records of those authorities. Over the past years, the European Commission has continued bypassing public or parliamentary scrutiny and EU legislative frameworks as it concludes ever more controversial and untransparent deals with non-EU countries, throwing at them large sums of money with no genuine human rights safeguards or monitoring mechanisms, with the aim to contain and deter migration and onwards movement of refugees toward the EU at seemingly any human cost.\u003C\u002Fspan>\u003C\u002Fp>\n\u003Cp> \u003C\u002Fp>\n\u003Ch3>\u003Cb>Human costs of externalisation\u003C\u002Fb>\u003C\u002Fh3>\n\u003Cp> \u003C\u002Fp>\n\u003Cp>\u003Cspan style=\"font-weight: 400;\">Attempts to outsource asylum to third countries are a manifestation of states’ flagrant shirking of their legal responsibility for people in need of protection. Outsourcing asylum processing and protection to third countries who cannot provide effective protection or are already disproportionately hosting refugees, is inconsistent with the objective and spirit of the Refugee Convention. It also obfuscates \u003C\u002Fspan>\u003Ca href=\"https:\u002F\u002Fwww.kaldorcentre.unsw.edu.au\u002Fsites\u002Fkaldorcentre.unsw.edu.au\u002Ffiles\u002FPolicy_Brief_11_Offshore_Processing.pdf\">\u003Cspan style=\"font-weight: 400;\">jurisdiction and responsibility\u003C\u002Fspan>\u003C\u002Fa>\u003Cspan style=\"font-weight: 400;\">, making it more difficult for people to access justice when their rights are violated. Persistent human rights abuses arise as a result\u003C\u002Fb>\u003Cspan style=\"font-weight: 400;\">, including the imposition of \u003C\u002Fspan>\u003Ca href=\"https:\u002F\u002Fwww.hrw.org\u002Fnews\u002F2023\u002F12\u002F20\u002Fwhat-happened-here-should-have-been-warning-not-inspiration\">\u003Cspan style=\"font-weight: 400;\">conditions amounting to inhumane and degrading treatment\u003C\u002Fspan>\u003C\u002Fa>\u003Cspan style=\"font-weight: 400;\">, neglect, a lack of access to legal aid, lack of identification of and support for specific needs, and family separation. This should have served as a warning. But more recent attempts – such as the \u003C\u002Fspan>\u003Ca href=\"https:\u002F\u002Feur01.safelinks.protection.outlook.com\u002F?url=https%3A%2F%2Fwww.amnesty.org.uk%2Ffiles%2F2024-02%2FAIUK%2520Asylum%2520policy%2520briefing%2520update%252029%2520Feb.pdf%3FVersionId%3DRUT.dxcKYoqNjJxymgs3aAHGozOUruIb&data=05%7C02%7Cstephanie.pope%40oxfam.org%7C83453f7e1d2e441e0d6d08dc84ad500c%7Cc42c6655bda0417590bab6e48cacd561%7C0%7C0%7C638531128869255147%7CUnknown%7CTWFpbGZsb3d8eyJWIjoiMC4wLjAwMDAiLCJQIjoiV2luMzIiLCJBTiI6Ik1haWwiLCJXVCI6Mn0%3D%7C0%7C%7C%7C&sdata=0DhDfTfyIWzJmw2N9LLckPbIxmKJQbhKMBl7UoN%2FKE8%3D&reserved=0\">\u003Cspan style=\"font-weight: 400;\">UK-Rwanda\u003C\u002Fspan>\u003C\u002Fa>\u003Cspan style=\"font-weight: 400;\"> asylum scheme, which is not yet in effect following the \u003C\u002Fspan>\u003Ca href=\"https:\u002F\u002Fwww.hrw.org\u002Fnews\u002F2024\u002F01\u002F30\u002Fuk-should-abandon-dangerous-authoritarian-rwanda-bill\">\u003Cspan style=\"font-weight: 400;\">UK Supreme Court declaring it unlawful\u003C\u002Fspan>\u003C\u002Fa>\u003Cspan style=\"font-weight: 400;\"> and in any event is unlikely to be operationalised at any significant scale – have already led to people being placed in detention and in a damaging legal limbo under threat of removal. Sending asylum seekers to Rwanda and other third countries breaches arrival countries’ obligations \u003C\u002Fspan>\u003Cspan style=\"font-weight: 400;\">under \u003C\u002Fspan>\u003Ca href=\"https:\u002F\u002Fwww.hrw.org\u002Fnews\u002F2024\u002F04\u002F23\u002Fuks-harmful-rwanda-bill-become-law\">\u003Cspan style=\"font-weight: 400;\">international refugee norms\u003C\u002Fspan>\u003C\u002Fa>\u003Cspan style=\"font-weight: 400;\">, and undermines their commitment to the rule of law. \u003C\u002Fspan>\u003C\u002Fp>\n\u003Cp> \u003C\u002Fp>\n\u003Cp>\u003Cspan style=\"font-weight: 400;\">The EU and Member States’ false promises of ensuring compliance with fundamental rights in the context of externalisation arrangements are no more than empty words. As the extensive track record of human rights violations in partner countries such as \u003C\u002Fspan>\u003Ca href=\"https:\u002F\u002Fwww.amnesty.org\u002Fen\u002Fdocuments\u002Fmde19\u002F4439\u002F2021\u002Fen\u002F\">\u003Cspan style=\"font-weight: 400;\">Libya\u003C\u002Fspan>\u003C\u002Fa>\u003Cspan style=\"font-weight: 400;\"> demonstrates, the EU and Member States have no adequate tools and competencies to effectively monitor or enforce human rights standards outside of EU territory. \u003C\u002Fspan>\u003C\u002Fp>\n\u003Cp> \u003C\u002Fp>\n\u003Cp>\u003Cspan style=\"font-weight: 400;\">Beyond the dire human cost, these arrangements also have a \u003C\u002Fspan>\u003Cb>ruinous impact on the administration and cost of asylum systems, \u003C\u002Fb>\u003Cspan style=\"font-weight: 400;\">with the UK’s attempts to forcibly remove people to Rwanda being\u003C\u002Fspan>\u003Ca href=\"https:\u002F\u002Feur01.safelinks.protection.outlook.com\u002F?url=https%3A%2F%2Fwww.theguardian.com%2Fuk-news%2F2024%2Fmar%2F01%2Frwanda-plan-uk-asylum-seeker-cost-figures&data=05%7C02%7Cstephanie.pope%40oxfam.org%7C83453f7e1d2e441e0d6d08dc84ad500c%7Cc42c6655bda0417590bab6e48cacd561%7C0%7C0%7C638531128869270476%7CUnknown%7CTWFpbGZsb3d8eyJWIjoiMC4wLjAwMDAiLCJQIjoiV2luMzIiLCJBTiI6Ik1haWwiLCJXVCI6Mn0%3D%7C0%7C%7C%7C&sdata=tRTuLoGWQrv1kiSxrEoxnSee%2F63g2g8db0vituMius0%3D&reserved=0\"> \u003Cspan style=\"font-weight: 400;\">projected\u003C\u002Fspan>\u003C\u002Fa>\u003Cspan style=\"font-weight: 400;\"> to cost a staggering £1.8 million per asylum seeker returned. This is not only an unjustifiable waste of public money, but also a lost opportunity to spend it in ways that would truly aid people seeking asylum by investing in fair and humane asylum systems and the communities that welcome them.\u003C\u002Fspan>\u003C\u002Fp>\n\u003Cp> \u003C\u002Fp>\n\u003Ch3>\u003Cb>Ripple effects of evading responsibility\u003C\u002Fb>\u003C\u002Fh3>\n\u003Cp> \u003C\u002Fp>\n\u003Cp>\u003Cspan style=\"font-weight: 400;\">The political feasibility of externalisation arrangements has also been heavily contested, given third countries’ reluctance to take on responsibility for asylum seekers or refugees that Europe refuses to welcome. The outsourcing of asylum processing and refugee protection \u003C\u002Fspan>\u003Cb>sends a dangerous signal to countries in the global South on EU countries’ refusal to uphold their responsibilities towards refugees and do their fair share\u003C\u002Fb>\u003Cspan style=\"font-weight: 400;\">. Far from showing international solidarity, the EU is attempting to further push its responsibilities onto countries who already host the majority of refugees with often far fewer resources – a policy that is not necessarily conducive to building global influence, the European Commission’s \u003C\u002Fspan>\u003Ca href=\"https:\u002F\u002Fwww.politico.eu\u002Fwp-content\u002Fuploads\u002F2024\u002F04\u002F18\u002Fdraft-IntPa-briefing-for-next-Com-April-2024-1-cleaned.pdf\">\u003Cspan style=\"font-weight: 400;\">stated aim\u003C\u002Fspan>\u003C\u002Fa>\u003Cspan style=\"font-weight: 400;\">. Simultaneously, the bloc is reducing the non-migration-related support it offers partner countries, by \u003C\u002Fspan>\u003Ca href=\"https:\u002F\u002Fpolicy-practice.oxfam.org\u002Fresources\u002Ffrom-development-to-deterrence-migration-spending-under-the-eu-neighbourhood-de-621536\u002F\">\u003Cspan style=\"font-weight: 400;\">redirecting\u003C\u002Fspan>\u003C\u002Fa>\u003Cspan style=\"font-weight: 400;\"> already scarce aid to efforts to prevent migration, and spending large shares of development aid on domestic programmes. Almost \u003C\u002Fspan>\u003Ca href=\"https:\u002F\u002Fwww.oecd.org\u002Fdac\u002FODA-summary-2023.pdf\">\u003Cspan style=\"font-weight: 400;\">17%\u003C\u002Fspan>\u003C\u002Fa>\u003Cspan style=\"font-weight: 400;\"> of EU Development Assistance Committee (DAC) members’ Official Development Assistance (ODA) is allocated to in-donor refugee costs, meaning it never leaves their territories. \u003C\u002Fspan>\u003Ca href=\"https:\u002F\u002Fwww.caritas.eu\u002Fwp-content\u002Fuploads\u002F2024\u002F01\u002FJoint-letter_GSP-reform_readmission-conditionality_Feb-2023.pdf\">\u003Cspan style=\"font-weight: 400;\">Trade\u003C\u002Fspan>\u003C\u002Fa>\u003Cspan style=\"font-weight: 400;\"> or visa relations have also become bargaining chips in controversial deals with non-EU countries to press them to fulfil the EU’s domestic migration objectives.\u003Cbr \u002F>\n\u003C\u002Fspan>\u003C\u002Fp>\n\u003Cp> \u003C\u002Fp>\n\u003Cp>\u003Cspan style=\"font-weight: 400;\">This\u003C\u002Fspan>\u003Cb> lack of commitment to responsibility sharing, international treaties and the global refugee protection system \u003C\u002Fb>\u003Cspan style=\"font-weight: 400;\">is \u003C\u002Fspan>\u003Ca href=\"https:\u002F\u002Fwww.hrw.org\u002Fnews\u002F2024\u002F01\u002F30\u002Fuk-should-abandon-dangerous-authoritarian-rwanda-bill\">\u003Cspan style=\"font-weight: 400;\">not lost on partner countries\u003C\u002Fspan>\u003C\u002Fa>\u003Cspan style=\"font-weight: 400;\">, and risks \u003C\u002Fspan>\u003Ca href=\"https:\u002F\u002Fwww.independent.co.uk\u002Fvoices\u002Fas-the-kenyan-minister-for-national-security-here-s-why-i-m-shutting-the-world-s-biggest-refugee-camp-a7020891.html\">\u003Cspan style=\"font-weight: 400;\">undermining\u003C\u002Fspan>\u003C\u002Fa>\u003Cspan style=\"font-weight: 400;\"> their willingness to provide protection: why would other major refugee hosting countries be incentivised to take on the EU’s responsibility for refugee protection, when the EU itself refuses to uphold the right to seek asylum on its territory? The potential ripple effect could be devastating for refugee protection globally. \u003C\u002Fspan>\u003C\u002Fp>\n\u003Cp> \u003C\u002Fp>\n\u003Cp>\u003Ca href=\"https:\u002F\u002Fwww.hrw.org\u002Fnews\u002F2024\u002F04\u002F15\u002Fcivil-society-organisations-call-meps-vote-down-harmful-eu-migration-pact\">\u003Cspan style=\"font-weight: 400;\">Civil society organisations\u003C\u002Fspan>\u003C\u002Fa>\u003Cspan style=\"font-weight: 400;\"> have been \u003C\u002Fspan>\u003Ca href=\"https:\u002F\u002Fwww.hrw.org\u002Fnews\u002F2023\u002F12\u002F21\u002Feus-migration-pact-disaster-migrants-and-asylum-seekers\">\u003Cspan style=\"font-weight: 400;\">clear about\u003C\u002Fspan>\u003C\u002Fa>\u003Cspan style=\"font-weight: 400;\"> their \u003C\u002Fspan>\u003Ca href=\"https:\u002F\u002Fwww.amnesty.org\u002Fen\u002Flatest\u002Fnews\u002F2024\u002F04\u002Feu-migration-asylum-pact-put-people-at-risk-human-rights-violations\u002F\">\u003Cspan style=\"font-weight: 400;\">serious concerns\u003C\u002Fspan>\u003C\u002Fa>\u003Cspan style=\"font-weight: 400;\"> with regards to the recently agreed reforms under the Pact on Migration and Asylum. Nonetheless, the transfer of asylum seekers outside of EU territory for asylum processing and refugee protection is not provided for in the Pact, nor within current EU law. After the EU and Member States have spent close to a decade attempting to reform the EU’s asylum system, they should now focus on implementing it with a human rights centred approach that prioritises the right to asylum per EU law and fundamental principles of international refugee law to which they remain bound. They should not, mere weeks after the reform has passed, waste further time and resources on proposals that are incompatible with European and international
