The vessel launched a rescue operation, since the boat in distress had started to sink. Meanwhile, the people had called the initiative \u003Cem>Watch The Med – Alarm Phone\u003C\u002Fem>, which alerted authorities and could match the boat with the one we monitored. The Italian \u003Cem>Maritime Rescue Coordination Centre\u003C\u002Fem> (MRCC) was called by our ground crew and declared “I will explain to you again: the position is in Libyan SAR (zone), so you don’t have to call me“ and hung up, despite the fact that the vessel involved was flying the Italian flag. The related shipping company \u003Cem>Augusta Offshore\u003C\u002Fem> S.p.A was contacted via email stressing that the rescued persons needed to be brought to a safe place in Europe and that a return to Libya would constitute a violation of international law. Our ground crew informed the Italian MRCC about developments, where the MRCC refused to provide any information. The people were ultimately disembarked by an \u003Cem>Italian Coast Guard\u003C\u002Fem> patrol boat in Lampedusa.\u003C\u002Fp>\n\u003Cp>04.10., distress case E, with around 50 persons:\u003Cstrong> Merchant vessel standing-by, \u003C\u002Fstrong>\u003Cstrong>delay to render assistance by authorities\u003C\u002Fstrong>. The people in distress had called the initiative \u003Cem>Watch The Med – Alarm Phone\u003C\u002Fem> on the previous day, which informed the authorities. The boat was spotted in the Maltese SAR zone adrift on 04.10. first by the NGO monitoring aircraft \u003Cem>Co\u003C\u002Fem>\u003Cem>libri 2*****\u003C\u002Fem>\u003Ca href=\"#_ftn4\" name=\"_ftnref4\">\u003C\u002Fa>, and later by \u003Cem>Seabird\u003C\u002Fem>. The merchant vessel \u003Cem>Nour 2\u003C\u002Fem>, flying the Libyan flag, was observed aside the boat in distress, monitoring the situation. The merchant vessel \u003Cem>Anastasia Ruta\u003C\u002Fem>, flying the Italian flag, was also in the vicinity. According to the NGO aircraft \u003Cem>Colib\u003C\u002Fem>\u003Cem>ri 2\u003C\u002Fem>, an Italian military aircraft was also on-scene and had an exchange with the merchant vessel \u003Cem>Anastasia Ruta\u003C\u002Fem>. More than two hours later, the situation was unchanged. On the radio, the Lampedusa port authorities informed \u003Cem>Seabird\u003C\u002Fem>’s crew that the rescue was coordinated by the Maltese authorities. Five hours after \u003Cem>Seabird\u003C\u002Fem>’s first sighting, the merchant vessel \u003Cem>Nour 2\u003C\u002Fem> confirmed that an \u003Cem>Armed Forces of Malta\u003C\u002Fem> patrol boat had rescued the people – and hence later disembarked them in Malta.\u003C\u002Fp>\n\u003Cp>04.10., \u003Cstrong>D\u003C\u002Fstrong>\u003Cstrong>e\u003C\u002Fstrong>\u003Cstrong>legation of the duty to render assistance to the Libyan authorities by the Maltese authorities, clear example of cooperation with \u003C\u002Fstrong>\u003Cem>\u003Cstrong>Joint Rescue and Coordination Centre\u003C\u002Fstrong>\u003C\u002Fem>\u003Cstrong> Tripoli, incapacity of the Libyan authorities to conduct a rescue operation\u003C\u002Fstrong>. When our ground crew called the Libyan authorities on the phone, they provided us with different positions of open cases. For the first position, the Libyan authorities confirmed that they were “unable to send out a patrol boat to search for the people due to ‘problems in the port’”, but due to the language barrier they were unable to specify the type of problems. A second position, near to the boundary with the Maltese SAR zone, could not be verified by \u003Cem>Seabird’s \u003C\u002Fem>crew. \u003Cstrong>The Libyan authorities confirmed to us over the phone that they had received the \u003C\u002Fstrong>\u003Cstrong>mentioned \u003C\u002Fstrong>\u003Cstrong>information\u003C\u002Fstrong>\u003Cstrong> about the open cases\u003C\u002Fstrong>\u003Cstrong> from the “\u003C\u002Fstrong>\u003Cem>\u003Cstrong>Maltese Coast Guard\u003C\u002Fstrong>\u003C\u002Fem>\u003Cstrong>”.\u003C\u002Fstrong> The outcomes for both boats remain unknown.\u003C\u002Fp>\n\u003Cp>17.10., distress case I, with around 10 persons: \u003Cstrong>Use of a RHIB******\u003C\u002Fstrong>\u003Ca href=\"#_ftn5\" name=\"_ftnref5\">\u003C\u002Fa>\u003Cstrong> by the so-called \u003C\u002Fstrong>\u003Cem>\u003Cstrong>Libyan Coast Guard\u003C\u002Fstrong>\u003C\u002Fem>\u003Cstrong> for an interception\u003C\u002Fstrong>. The so-called \u003Cem>Libyan Coast Guard\u003C\u002Fem> deployed an approximately 10-meter-long RHIB, which they used to intercept the people in distress from a fiberglass boat. After all of the people were brought aboard the RHIB, they towed the boat with a rope. It was the first time that the monitoring aircraft \u003Cem>Seabird \u003C\u002Fem>had sighted this RHIB operated by the so-called \u003Cem>Libyan Coast Guard.\u003C\u002Fem> Other sources show this fast boat already operational in 2016 but also most recently in November 2021.\u003C\u002Fp>\n\u003Cp>17.-18.10., distress cases J, K, M, P with respectively 54, 59, 63 and 27 persons: \u003Cstrong>Several\u003C\u002Fstrong>\u003Cstrong> \u003C\u002Fstrong>\u003Cstrong>rescue operations undertaken by the civil sea rescue vessel \u003C\u002Fstrong>\u003Cem>\u003Cstrong>Sea-Watch 3\u003C\u002Fstrong>\u003C\u002Fem>\u003Cstrong> with the support of monitoring aircraft \u003C\u002Fstrong>\u003Cem>\u003Cstrong>Seabird\u003C\u002Fstrong>\u003C\u002Fem>. Three of the four boats in distress were first spotted by \u003Cem>Seabird’s \u003C\u002Fem>crew and subsequently rescued by the NGO vessel \u003Cem>Sea-Watch 3\u003C\u002Fem>. The \u003Cem>Sea-Watch 3 \u003C\u002Fem>sighted the people aboard distress case K shortly before \u003Cem>Seabird\u003C\u002Fem>’s crew. The rescues represent four of seven rescues of a total of 412 people conducted by the \u003Cem>Sea-Watch 3 \u003C\u002Fem>between October 17th and 18th, 2021. The people were disembarked in Pozzallo, Italy on October 23-24, 2021.\u003C\u002Fp>\n\u003Cp>18.10., distress case N with around 60 persons on board: \u003Cstrong>Dangerous \u003C\u002Fstrong>\u003Cstrong>manoeuvres \u003C\u002Fstrong>\u003Cstrong>during an illegal interception by the so-called \u003C\u002Fstrong>\u003Cem>\u003Cstrong>Libyan Coast Guard\u003C\u002Fstrong>\u003C\u002Fem>.*******\u003Ca href=\"#_ftn6\" name=\"_ftnref6\">\u003C\u002Fa> When \u003Cem>Seabird\u003C\u002Fem>’s crew arrived on-scene, the so-called \u003Cem>Libyan Coast Guard\u003C\u002Fem> were trying to intercept the people in distress, who had started their engine again. The so-called \u003Cem>Libyan Coast Guard \u003C\u002Fem>acutely endangered the people on the wooden boat through dangerous manoeuvres – patrol boat PB634 repeatedly drove extremely close towards the wooden boat. Under the monitoring of \u003Cem>Seabird\u003C\u002Fem>’s crew, the people on board tried to escape the illegal interception. However they were subsequently pulled back to Libya.\u003C\u002Fp>\n\u003Cp>In October, \u003Cem>Seabird\u003C\u002Fem>’s crews spotted\u003Cstrong> \u003C\u002Fstrong>\u003Cstrong>6 empty boats\u003C\u002Fstrong>\u003Cstrong>. \u003C\u002Fstrong>The empty boat spotted on October 20th might have been the remains of a boat in distress which was already sighted by \u003Cem>Seabird \u003C\u002Fem>previously and was likely\u003Cem> \u003C\u002Fem>intercepted on October 18th.
