The merchant vessel \u003Cem>Wine Trade\u003C\u002Fem>\u003Cem>r\u003C\u002Fem> was in the vicinity and heading to the position as communicated with \u003Cem>Seabird 2\u003C\u002Fem>’s crew, however the vessel did not render assistance. The responsible shipping company was informed on the phone and via email. In the evening, the NGO vessel \u003Cem>Astral\u003C\u002Fem>\u003Ca href=\"#_ftn1\" name=\"_ftnref1\">\u003C\u002Fa> (6) located the persons. The persons were then ultimately rescued by the Italian authorities and disembarked in Lampedusa, Italy.\u003Cbr \u002F>\n11.08., distress case M, 121 persons: \u003Cstrong>Successful civil coordination, NGOs filling the gap left by authorities\u003C\u002Fstrong>. On 11.08., the civilian aircraft \u003Cem>Colibri 2\u003C\u002Fem>\u003Ca href=\"#_ftn1\" name=\"_ftnref1\">\u003C\u002Fa> (7) informed authorities and NGOs about a boat in distress. Shortly afterwards, \u003Cem>Seabird 2\u003C\u002Fem>’s crew sighted the persons in the Maltese SAR region. Due to the lack of state rescue assets in the Mediterranean, the NGO vessel \u003Cem>Nadir\u003C\u002Fem>\u003Ca href=\"#_ftn2\" name=\"_ftnref2\">\u003C\u002Fa> (8) changed course towards the position and was then able to assist the persons two hours after \u003Cem>Seabird 2\u003C\u002Fem>’s sighting. The people were finally rescued by the \u003Cem>Italian Coast Guard\u003C\u002Fem> in the evening and disembarked in Lampedusa, Italy.\u003C\u002Fp>\n\u003Cp>18.08., distress case P, around 20 persons: \u003Cstrong>Non-assistance by Italian and Maltese authorities, illegal interception by the \u003C\u002Fstrong>\u003Cem>\u003Cstrong>Tunisian Coast Guard\u003C\u002Fstrong>\u003C\u002Fem>\u003Cstrong> in the Maltese (!) SAR region\u003C\u002Fstrong>. On 17.08., the initiative \u003Cem>Watch The Med – Alarm Phone\u003C\u002Fem> was called by persons in distress and informed the authorities. \u003Cem>Seabird 2\u003C\u002Fem>’s crew spotted the persons in the Maltese SAR region on 18.08. at noon, still without any rescue capacity in sight. The \u003Cem>Tunisian Coast Guard\u003C\u002Fem> was spotted in the vicinity, approaching the boat.\u003Cem> Seabird 2\u003C\u002Fem>’s crew then witnessed \u003Cstrong>the illegal interception of persons in distress by the \u003C\u002Fstrong>\u003Cem>\u003Cstrong>Tunisian Coast Guard\u003C\u002Fstrong>\u003C\u002Fem>\u003Cstrong> within the Maltese (!) SAR region \u003C\u002Fstrong>(9).\u003Ca href=\"#_ftn1\" name=\"_ftnref1\">\u003C\u002Fa> The people were subsequently pulled back to Tunisia.\u003C\u002Fp>\n\u003Cp>\u003Cstrong>Tunisia can\u003C\u002Fstrong>\u003Cstrong>not\u003C\u002Fstrong>\u003Cstrong> be considered as a place of safety\u003C\u002Fstrong>\u003Cstrong> for people rescued at sea\u003C\u002Fstrong>\u003Cstrong>,\u003C\u002Fstrong> as defined by the \u003Cem>International Maritime Organization\u003C\u002Fem>’s Resolution MSC. 167(78). Firstly, there exists \u003Cstrong>no \u003C\u002Fstrong>\u003Cstrong>domestic asylum system \u003C\u002Fstrong>in Tunisia – meaning that asylum-seekers are left without legal protection. Persons on the move are arbitrarily detained, since unauthorised entry and stay are criminalized, while the legal framework related to detention remains unclear (10).\u003Ca href=\"#_ftn1\" name=\"_ftnref1\">\u003C\u002Fa> Furthermore, Tunisia has previously conducted several \u003Cstrong>chain-refoulements\u003C\u002Fstrong> to other states, including Libya\u003Ca href=\"#_ftn1\" name=\"_ftnref1\">\u003C\u002Fa> (11)– meaning that there is a risk that persons on the move are brought to other unsafe countries. Finally, people on the move, but also other persons affected by discrimination and criminalization, in particular LGBTQI* persons, can in Tunisia be subjected to \u003Cstrong>human rights violations\u003C\u002Fstrong> (12).\u003Ca href=\"#_ftn2\" name=\"_ftnref2\">\u003C\u002Fa>\u003C\u002Fp>\n\u003Cp>On 25.08., our ground crew routinely called the Libyan \u003Cem>Joint Rescue Operation Centre\u003C\u002Fem> (JRCC) in order to ask for open distress cases at sea. The JRCC Tripoli provided 6 positions for distress cases, stating that the patrol boat PB 301 of the so-called \u003Cem>Libyan Coast Guard\u003C\u002Fem> had intercepted 5 out of the 6. The sixth boat was rescued by an NGO, according to the officer on the phone.\u003C\u002Fp>\n\u003Cp>On 25.08., \u003Cem>Seabird 2\u003C\u002Fem> spotted a total of 6 boats in distress. Three of the boats, distress cases R, S and U, concerned approximately 40, 119 and 66 persons. \u003Cstrong>Rescues were made possible once again through\u003C\u002Fstrong> \u003Cstrong>joint and successful efforts by the civil fleet.\u003C\u002Fstrong>\u003C\u002Fp>\n\u003Cp>Distress case R first reached out to the \u003Cem>Initiative Watch the Med – Alarm Phone,\u003C\u002Fem> which informed authorities as well as civil actors present in the area, so that the civil monitoring aircraft \u003Cem>Colibri 2\u003C\u002Fem> was subsequently able to spot the people. At that time, the boat’s engine was not running and the persons were in acute distress at sea. The NGO vessel \u003Cem>Ocean Viking\u003C\u002Fem> acknowledged the distress call and changed course towards the boat. Seabird 2 was also able to spot the boat. In the evening, \u003Cem>Ocean Viking\u003C\u002Fem> conducted a rescue and took approximately 40 people on board.\u003C\u002Fp>\n\u003Cp>Distress case S was first spotted by \u003Cem>Colibri 2\u003C\u002Fem> and then by \u003Cem>Seabird 2\u003C\u002Fem>. The NGO vessel \u003Cem>Ocean Viking\u003C\u002Fem> reached the position of the people in distress approximately 3 hours later and was able to safely embark 119 persons.\u003C\u002Fp>\n\u003Cp>\u003Cem>Seabird 2\u003C\u002Fem> spotted distress case U first in the afternoon of 25.08., informing the authorities and civil actors present in the area. On 26.08., \u003Cem>Seabird 2\u003C\u002Fem> sighted the boat again, which was at that time accompanied by two fishing vessels which were asking for help via the emergency radio channel 16. \u003Cem>Seabird 2\u003C\u002Fem> sent out 2 mayday relays\u003Ca href=\"#_ftn1\" name=\"_ftnref1\">\u003C\u002Fa> (13) on behalf of the people in distress. The NGO sailing vessel \u003Cem>Astral \u003C\u002Fem>acknowledged the distress calls and headed towards the position in order to assist the persons. During the afternoon of 26.08., the \u003Cem>Italian Coast Guard\u003C\u002Fem> conducted a rescue and disembarked the persons in Lampedusa, Italy.\u003C\u002Fp>\n\u003Cp>27.08., distress case AJ, approximately 12 persons: \u003Cstrong>Non-assistance by a merchant vessel, outcome of the distress case unknown\u003C\u002Fstrong>. \u003Cem>Seabir\u003C\u002Fem>\u003Cem>d 2\u003C\u002Fem> spotted the boat in distress during the afternoon and informed the authorities. The merchant vessel \u003Cem>Iver Ambassador\u003C\u002Fem>, flying the flag of the Marshall Islands, could be successfully reached and changed course towards the boat in distress. Shortly afterwards however, \u003Cstrong>the vessel stated that it did not consider the boat as in distress, arguing that people are not in the water\u003C\u002Fstrong>. \u003Cem>Seabird 2\u003C\u002Fem> then had to leave the scene. The outcome for the boat in distress remains unknown.\u003C\u002Fp>\n\u003Cp>29.08., distress case AL, 18 persons: \u003Cstrong>Merchant vessel chartered by the \u003C\u002Fstrong>\u003Cem>\u003Cstrong>European Fishery Control Agency\u003C\u002Fstrong>\u003C\u002Fem>\u003Cstrong> (EFCA) leaving a distress case unattended, apparently instructed by Malta, eventual rescue by NGO vessel\u003C\u002Fstrong>. \u003Cem>Seabird 2\u003C\u002Fem> spotted an overcrowded boat in distress with children on board and accordingly informed the authorities and civil actors in the area. The NGO vessel \u003Cem>Geo Barents\u003C\u002Fem> acknowledged the information and confirmed its arrival on scene several hours later. The merchant vessel\u003Cem> Lundy Senti\u003C\u002Fem>\u003Cem>ne\u003C\u002Fem>\u003Cem>l\u003C\u002Fem>, flying the Portuguese flag, was in close proximity to the boat in distress. \u003Cem>Seabird 2\u003C\u002Fem> at first unsuccessfully attempted to contact the\u003C\u002Fp>\n\u003Cp>merchant vessel, where the vessel later confirmed that it would change course towards the boat in distress. Shortly afterwards, the \u003Cem>Lundy Sentinel\u003C\u002Fem> moved away from the distress case and hence refused to conduct the rescue. Finally, the NGO vessel \u003Cem>Geo Barents\u003C\u002Fem> arrived to the scene and took all of the people safely on board.\u003C\u002Fp>\n\u003Cp>In August 2022, with its aircraft \u003Cem>Osprey 2\u003C\u002Fem> and \u003Cem>Osprey 3\u003C\u002Fem>, we must assume that the European Border and Coast Guard Agency \u003Cem>\u003Cstrong>Frontex \u003C\u002Fstrong>\u003C\u002Fem>was involved in the narratives for at least 2 boats in distress, concerning around 28 persons, also sighted by \u003Cem>Seabird 2\u003C\u002Fem>’s crews in the Maltese SAR zone.
